1. The Tour Service Contract

Rio Celeste Concierge provides and operates premium private guiding and adventure tourism services (including, but not limited to: privately guided rainforest treks, VIP waterfall hikes, and private river tubing sessions). The scope of our services is strictly limited to the details specified in the official booking confirmation generated by our automated platform.

2. Bookings on Behalf of Third Parties

If you are making a reservation on behalf of a group, family, couple, or any other individuals, you formally guarantee and warrant that:

• You have the explicit legal authority and consent from each member of your party to act on their behalf.
• You have shared, explained, and provided these Terms & Conditions in full to every traveler in your group.
• By confirming the booking, you accept full responsibility, liability waivers, and financial obligations on behalf of all participants included in the reservation.

3. Payment Terms & Financial Policies

To ensure maximum data security and a seamless booking experience for our discerning guests, all financial transactions are strictly standardized:

• Payment Platform: All digital transactions, credit card processing, and deposits are handled securely through the FareHarbor booking engine.
• Deposit & Full Payment Policy: To secure a guaranteed private date and naturalist guide, 100% full payment is required at the time of online booking, unless a custom payment schedule has been agreed upon in writing by our Concierge desk.
• The Company reserves the right to automatically cancel any itinerary or hold without notice if payment is not fully processed or verified within the required timeframe.

4. Guest Conduct & Environmental Responsibilities

Guest safety and the strict preservation of Costa Rica’s fragile ecosystems are our highest priorities. While participating in our tours, guests must strictly adhere to the following rules:

• Strict Prohibition of Swimming in Protected Sectors: In accordance with Costa Rican environmental laws and SINAC national park regulations, swimming or stepping into the water within the boundaries of the Tenorio Volcano National Park is strictly prohibited (this includes the Rio Celeste waterfall pool and Los Teñideros). Our private tubing experiences operate strictly outside national park boundaries in open, pristine, and fully authorized sectors of the exact same blue river flow.
• Wildlife Protection: Feeding, touching, harassing, or disrupting wild animals is strictly forbidden, as is the removal of any flora, rocks, or natural artifacts from the rainforest.
• Guide Instructions: Guests must follow all safety rules and operational commands given by our certified naturalist guides at all times. Failure to comply with safety warnings grants the guide the authority to terminate the tour immediately without any right to a refund.

5. Assumption of Risk & Liability Waiver

The Client fully understands that the experiences provided by Rio Celeste Concierge take place in wild, unpredictable natural environments and involve active adventure tourism (hiking on uneven, muddy terrain; navigating river rapids on tubes; and exposure to tropical weather and wildlife). Consequently, the Client knowingly assumes the following terms:

Our guides are thoroughly trained in first aid, wilderness safety, and swiftwater rescue protocols, and top-tier safety equipment (life jackets, helmets) is provided for all technical tours. However, the Company limits its liability for any incidents resulting from a guest’s self-imprudency or failure to follow guide instructions.

6. Medical & Travel Insurance

It is the sole and mandatory responsibility of each individual guest (particularly international travelers) to obtain and maintain a comprehensive **travel insurance policy**. This insurance should explicitly cover medical expenses, emergency evacuation, active adventure sports (such as hiking and river tubing), and trip cancellations due to airline disruptions or personal issues.

Rio Celeste Concierge holds comprehensive civil liability insurance policies as required by the Costa Rican Tourism Board (ICT); however, these do not replace the necessity of a personal medical travel insurance plan for individual health contingencies.

7. Force Majeure & Severe Weather Policies

If the Costa Rican National Park authorities declare an official closure of the Tenorio Volcano National Park due to extreme weather warnings, volcanic activity, or force majeure events, Rio Celeste Concierge will instantly offer the guest:

• Priority rescheduling windows to move the tour to an alternative date via our FareHarbor system.
• A full 100% financial refund if the guest’s travel itinerary makes rescheduling impossible.

8. Governing Law & Jurisdiction

This legal contract, its interpretation, execution, and any legal disputes or claims arising directly or indirectly from the services rendered by Rio Celeste Concierge shall be governed exclusively by the **laws of the Republic of Costa Rica**. Both parties explicitly agree to submit to the jurisdiction of the competent courts in Costa Rican territory, waiving any other international jurisdiction or rights based on their home country of residence.
